Terms of Service
MedSchoolCoach is an academic consulting and tutoring firm. While we work to help you reach your full potential and strengthen your academic and professional profile, we cannot guarantee any specific results or outcomes unless a particular service explicitly states otherwise. All final decisions on grades, applications, and interviews are made by external, unaffiliated parties.
Our goal is to give you every essential tool and advantage, but we will not:
- Complete your applications
- Write your letters, CV, or personal statements
- Guarantee test scores, admission decisions, or similar outcomes
Applicants remain responsible for following each school’s instructions and ensuring their materials arrive on time. Your academic performance also depends on many factors beyond our control.
MedSchoolCoach operates ethically and relies solely on publicly available data. We are not affiliated with, nor do we endorse, any universities, colleges, official test administrators, or external websites unless explicitly stated.
Availability of our advisors & tutors:
MedSchoolCoach, LLC schedules consulting and editing services at its discretion, while giving due regard to each client’s needs. Edits will be returned no later than 168 hours (seven days) after we receive the initial draft, except in extenuating circumstances; most edits are completed within 72 hours. Please schedule phone consultations at least 48 hours in advance and mock interviews at least 96 hours in advance. For urgent matters, we will make every effort to accommodate shorter notice.
Cancellations of Sessions:
To cancel or reschedule any tutoring or advising session—including interview preparation—please give us at least 24 hours’ notice. We understand that emergencies and unforeseen circumstances can arise, so contact us as soon as possible if they do. Repeated late cancellations or reschedules may, depending on the circumstances, result in a fee being added to your account, and MedSchoolCoach reserves the right to suspend services with no refunds available.
Editing Services:
I acknowledge that MedSchoolCoach, LLC will never write any part of my essays. MedSchoolCoach will guide me through the writing process and provide detailed revisions; however, no portion of my personal statement or application will be written by MedSchoolCoach. As required by the AMCAS certification, I confirm that all written passages—including the personal statement, essays for M.D./Ph.D. applicants, and descriptions of work and activities—are entirely my own and have not been written, in whole or in part, by a third party. Quotations may be used only if the source is properly cited.
Furthermore, I understand that the use of artificial intelligence (AI) tools to generate or compose any portion of my application essays is not permitted. All submitted written materials must reflect my authentic voice and experiences, and must be written solely by me.
Confidentiality:
All communications between MedSchoolCoach, LLC and the client are strictly confidential. Your name and work will never be shared outside our team of advisors. We take every reasonable step to protect your privacy: any information obtained during consultation sessions will be held in confidence, not disclosed to any third party (individual, group, corporation, etc.) or used in a study without your written consent.
Although safeguarding your privacy is our highest priority, MedSchoolCoach cannot guarantee the security of all electronic communications over the internet. Online communication is not always completely secure, and in the unlikely event of lost or stolen information, MedSchoolCoach will not be held responsible.
Termination of Services:
Either party may end this relationship at any time, for any reason, by providing written notice to the other party. If the relationship is terminated, no refunds can be issued.
Expiration of Services:
All application advising services at MedSchoolCoach—except residency advising—expire on
June 15 of the application package’s anticipated matriculation year, unless the student and the
Student Success Team arrange otherwise (for example, with an approved deferral or the Platinum
Package Guarantee). Residency advising packages expire on April 1 of the package’s anticipated
match year.
Tutoring services expire one calendar year from the purchase date unless the student, tutor, and
Student Success Team agree in advance to a different schedule.
All other advising or tutoring purchases expire one year after purchase unless an extension is
arranged before the expiration date or the product is sold as a multi-year offering.
Expiration applies to all unused package components and hours.
If you believe you will need more time within the original year, please email
help@medschoolcoach.com so we can review your
request.
Residency Match Guarantee (“Match Promise”):
If you purchase the Residency Platinum Package and do not match into a residency
program during your first ERAS application cycle, MedSchoolCoach will support your
reapplication in the next cycle at no additional cost.
Second-Cycle Support Includes:
- Updated personal statement
- Updated experience section
- Revised residency program list
Second-Cycle Support Does Not Include:
- Interview preparation (this can be purchased separately)
Eligibility Requirements:
- You must follow all guidance provided by your Physician Advisor throughout the process.
- You must complete a USMLE Step 2 score review to confirm your candidacy meets minimum program thresholds.
- Additional eligibility conditions may apply—please speak with your advisor or an enrollment team member for full details.
USMLE Step 2 Score Requirement:
To qualify for the Residency Platinum Match Guarantee, you must achieve a minimum USMLE Step 2 CK score within 10 points of the most recently published national average for matched applicants in your chosen specialty. This requirement helps ensure you apply with a competitive academic
profile aligned with successful match outcomes.
Refunds:
We strive to make every tutoring and advising experience exceptional. If we have
not met your expectations, you may request a refund under the conditions below.
All disclaimers remain in force.
Refund Policy for Services
- Timing: Submit any refund request within 30 days of
purchase. No refunds can be issued after this period, although the balance can be
converted to MedSchoolCoach credits (see below). Refunds cannot be issued for services
already provided under any circumstance. - Amount: If a refund is approved within 30 days, the amount
is determined by MedSchoolCoach.- Tutoring: Refunds are calculated on unused hours (each hour
charged at the lowest tier package hourly rate). - Advising: Refunds are calculated on services already rendered
(billed at $350/hour for standard advisors, $400/hour for master advisors,
and $450/hour for director-level advisors).
- Tutoring: Refunds are calculated on unused hours (each hour
- Processing Fee: A 5% administrative/processing fee is applied to
the total purchase amount for all refunds to cover credit-card fees and returned
payments. - Credits After 30 Days: Service cancellations after
30 days are processed as “MedSchoolCoach credits.” Credits may be used for
any MedSchoolCoach service within two years and may be transferred once to friends
or family. Credits can be converted only one time to other services. - Wait-list Exception: Advising students currently on a medical-school
waitlist who purchase services for the next application cycle may request a refund
within 120 days of purchase if accepted off the waitlist (proof of acceptance
required). Refunds in this case are based on services used to date.
Non-Refundable Products: Content purchases—such as MCAT Go, MCAT Practice Exams, MCAT CARS Mastery, and the MCAT Prep App—are not eligible for refunds
Credits:
Credits provide flexibility for applying unused balances toward other MedSchoolCoach
services. All disclaimers remain in force.
Credit Policy for Services
- Usage Across Services: Credits may be applied toward the purchase
of any MedSchoolCoach service. If the cost of the new service exceeds the available
credit balance, your Enrollment Manager will provide options for paying the difference.
Any unused portion of a credit will remain on your account for future use. - One-Time Conversion: Credits may only be applied once. If you
purchase a new service with your credit and do not use all of the purchased service,
the unused balance cannot be converted back into a new credit.
Example: Alexa used her credit of $2,200 to purchase 10 hours of MCAT tutoring.
She completed 8 hours. The remaining 2 hours could not be converted back into credits. - Transferability: Credits may be transferred once to one (1) individual
of your choosing. Your Enrollment Manager will assist with the transfer process. - Inability to Use: If you cannot use or transfer your credit, please
contact us. We will review your situation and may be able to assist. - Expiration: Credits are valid for two (2) years from the date of issuance.
If you anticipate needing to use your credit after two years, please notify us in advance.
Non-Credit Eligible Products: Content purchases—such as MCAT Go, MCAT Practice Exams,
the MCAT Prep App, and MCAT CARS Mastery—are not eligible for conversion into credits.
No Guarantee:
I understand and acknowledge that MedSchoolCoach, LLC does not guarantee its services will improve my chances of admission to medical school. Nonetheless, the advisors at MedSchoolCoach will make every reasonable effort to help me submit the strongest application possible.
Your responsibility:
The student is solely responsible for their entire application, including submitting all materials, meeting every deadline, and handling all communication with AMCAS, TMDSAS, AACOMAS, or individual medical schools.
“Platinum Package Promise” (Guarantee of Admission or
We Work with You Again Next Cycle):
Under the Platinum Package Promise, MedSchoolCoach, LLC will support your primary application
again in the next cycle—at no additional cost—if you are not accepted during the cycle in
which you used your Platinum Package.
Eligibility Requirements:
- Minimum MCAT score ≥ 502 and GPA ≥ 3.4 when applying only to MD programs
- Minimum MCAT score ≥ 500 and GPA ≥ 3.2 when applying to both DO & MD programs
- You must have followed all guidance provided by MedSchoolCoach advisors
If you meet these requirements, you will receive advising, personal-statement editing, and
activities editing for your AMCAS and AACOMAS applications in the next cycle. This support:
- Is valid only for the cycle immediately following your original Platinum Package use
- Cannot be transferred or deferred to a later cycle
- Does not guarantee a specific advisor (though we will consider your preferences)
- Excludes TMDSAS advising, MD/PhD advising, interview preparation, and secondary-application editing for the second cycle
“Pre-Med Concierge” Program Terms:
MedSchoolCoach, LLC’s Pre-Med Concierge Program offers comprehensive support for up to three years from your start date (the date of first payment). One full application cycle is included in this three-year package.
Program Duration & Flexibility
- The program lasts a maximum of three years, unless MedSchoolCoach grants a written extension.
- If your plans change (for example, you delay your application beyond the three-year period), you may:
- Pause services until you are ready to apply.
- Purchase additional time beyond the original three years.
What’s Included
- Comprehensive pre-med guidance: Personalized advising on extracurriculars, activities, and building a strong medical-school application.
- MCAT support:
- Up to 10 tutoring hours per year for MCAT or subject-specific topics.
- Access to all MedSchoolCoach MCAT prep resources, including the MCAT Prep App and Practice Exams.
- Medical-school application support:
- The Platinum-level application package (2025 version) for your application year.
- If packages change, you will receive equivalent services to ensure full support.
Guarantee – Free Reapplication Support
- If you are not accepted into medical school on your first attempt, MedSchoolCoach will support one additional application cycle at no extra cost.
- To qualify, you must follow all advice provided by your MedSchoolCoach advisor throughout the program, including school selection.
Payments & Renewals
- Payments are automatically deducted from the account on file according to your original invoice.
- If your package includes annual renewals, payments are processed on the anniversary of your start date each year.
- Additional services outside the package can be purchased separately and will have their own terms and pricing.
“Score Improvement Guarantee”:
The Score Improvement Guarantee applies only to students enrolled in a Silver, Gold, or Platinum Tutoring Package. To qualify, you must complete all of the steps below before tutoring begins:
- Use all tutoring hours included in your package.
- Before your first session, email a screenshot of your most recent NBME or AAMC MCAT score report—showing your name, test date, score, and score legend—to help@medschoolcoach.com.
- Within one week of your final tutoring session, take an NBME, USMLE, or MCAT exam.
- If your score has not improved, email a screenshot of the new score report (with the same identifying details) to help@medschoolcoach.com.
- Once verified, we will provide an additional 10 tutoring hours at no cost. No refunds can be issued.
USMLE Tutoring Guarantee:
We’re committed to your success. That’s why we stand behind our tutoring with these guarantees:
- Step 1 / Level 1 – Pass Guarantee: Complete 25-39 hours of tutoring and do not pass → 5 complimentary hours. Complete 40+ hours of tutoring and do not pass → 10 complimentary hours.
- Step 2 / Level 2 – Score Increase Guarantee: Complete 25-39 hours of tutoring and your score does not improve → 5 complimentary hours. Complete 40+ hours of tutoring and your score does not improve → 10 complimentary hours.
- Step 3 / Level 3 – Score Increase Guarantee: Complete 25-39 hours of tutoring and your score does not improve → 5 complimentary hours. Complete 40+ hours of tutoring and your score does not improve → 10 complimentary hours.
Important Details and Eligibility Guarantees apply to one Step/Level exam only. NBME and COMAT shelf exams are not included. Guarantees are offered only once per student, per Step/Level, regardless of the number of packages purchased. Complimentary hours are non-refundable and non-transferable. Definition of Hours Used Hours must be completed, billable tutoring sessions with a MedSchoolCoach tutor.
The guarantee applies only after all purchased hours in the package (25-39 or 40+) have been completed. Students must:
- Attend tutoring sessions consistently.
- Follow tutor guidance, including completion of assigned practice questions, exams, or study plans.
- Sit for the relevant Step/Level exam within 6 months of completing the tutoring package.
Documentation Requirements Pass Guarantee: requires an official, unaltered score report from NBME/NBOME showing a failing result.
Score Increase Guarantee: requires at least one documented, dated NBME/NBOME (or equivalent) exam prior to starting tutoring and an official score report from the relevant Step/Level exam
Guarantees do not apply if:
- The student switches exams (e.g., from Step 1 to Step 2) after beginning tutoring.
- The exam attempt is voided or invalidated by NBME/NBOME/ECFMG or equivalent authority.
- The exam is taken under non-standard or experimental conditions.
Timeframe for Claims: Guarantee claims must be submitted within 30 days of receiving official results, along with required documentation.
Guarantee effective October 1, 2025. For students who enrolled prior, please contact our student success team.
User Data:
Interactions and information obtained through
medschoolcoach.com
are always subject to your individual privacy settings on each social network.
Users may sign up or log in via third-party services (Google, Apple, Facebook),
which will share limited data—such as full name, email address, and profile photo—
with MedSchoolCoach.
Additional Terms:
Release of Liability
By purchasing MedSchoolCoach, LLC’s services, I release MedSchoolCoach—including its employees, consultants, and contractors (collectively, “MedSchoolCoach”)—from all claims, demands, or actions arising from the discussions and interpretations provided. The services rendered by MedSchoolCoach are the consideration for this release and disclaimer of liability.
Payment & Refunds
All services require full pre-payment unless noted otherwise. Fees paid to MedSchoolCoach are
non-refundable, and no partial refunds will be issued except at MedSchoolCoach’s discretion
(as detailed in the refund policy above). If a refund is granted, the amount is determined
solely by MedSchoolCoach at the time of termination. All advice provided remains the
intellectual property of MedSchoolCoach, and services are non-transferable. Parents and
significant others may participate in discussions. MedSchoolCoach reserves the right to
terminate a client relationship at any time and at its sole discretion.
Disputes & Arbitration
Any disputes, controversies, or claims arising out of or relating to this agreement shall be
submitted to binding arbitration pursuant to the rules of the American Arbitration
Association then in effect. In any litigation related to the subject matter of this
agreement, the non-prevailing party will reimburse the prevailing party for all reasonable
attorney fees and costs.
Software-Specific Terms & Policies
The products below (MCAT Go and the MCAT Prep App) are standalone digital tools. Because they collect data and function separately from our core advising services, each has its own Terms & Conditions and Privacy Policy.

Terms and Conditions of www.medschoolcoach.com
These Terms govern
- the use of www.medschoolcoach.com, and,
- any other related Agreement or legal relationship with the Owner
in a legally binding way. Capitalized words are defined in the relevant dedicated section of this document.
The User must read this document carefully.
Although the entire contractual relationship relating to these Products is entered into solely by the Owner and Users, Users acknowledge and agree that, where www.medschoolcoach.com has been provided to them via the Apple App Store, Apple may enforce these Terms as a third-party beneficiary.

- Please note that some provisions in these Terms may only apply to certain categories of Users. - The right of withdrawal only applies to European Consumers.

Single or additional conditions of use or access may apply in specific scenarios and in such cases are additionally indicated within this document.
By using www.medschoolcoach.com, Users confirm to meet the following requirements:
- There are no restrictions for Users in terms of being Consumers or Business Users;
- Users aren’t located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist-supporting” country;
- Users aren’t listed on any U.S. Government list of prohibited or restricted parties;
Account registration
To use the Service Users may register or create a User account, providing all required data or information in a complete and truthful manner.
Users may also use the Service without registering or creating a User account, however, this may cause limited availability of certain features or functions.
Users are responsible for keeping their login credentials confidential and safe. For this reason, Users are also required to choose passwords that meet the highest standards of strength permitted by www.medschoolcoach.com.
By registering, Users agree to be fully responsible for all activities that occur under their username and password.
Users are required to immediately and unambiguously inform the Owner via the contact details indicated in this document, if they think their personal information, including but not limited to User accounts, access credentials or personal data, have been violated, unduly disclosed or stolen.
Account termination
Users can terminate their account and stop using the Service at any time by doing the following:
- By directly contacting the Owner at the contact details provided in this document.
Account suspension and deletion
The Owner reserves the right, at its sole discretion, to suspend or delete at any time and without notice, User accounts which it deems inappropriate, offensive or in violation of these Terms.
The suspension or deletion of User accounts shall not entitle Users to any claims for compensation, damages or reimbursement.
The suspension or deletion of accounts due to causes attributable to the User does not exempt the User from paying any applicable fees or prices.
Content on www.medschoolcoach.com
Unless where otherwise specified or clearly recognizable, all content available on www.medschoolcoach.com is owned or provided by the Owner or its licensors.
The Owner undertakes its utmost effort to ensure that the content provided on www.medschoolcoach.com infringes no applicable legal provisions or third-party rights. However, it may not always be possible to achieve such a result.
In such cases, without prejudice to any legal prerogatives of Users to enforce their rights, Users are kindly asked to preferably report related complaints using the contact details provided in this document.

The Owner holds and reserves all intellectual property rights for any such content.
Users may not therefore use such content in any way that is not necessary or implicit in the proper use of the Service.
In particular, but without limitation, Users may not copy, download, share (beyond the limits set forth below), modify, translate, transform, publish, transmit, sell, sublicense, edit, transfer/assign to third parties or create derivative works from the content available on www.medschoolcoach.com, nor allow any third party to do so through the User or their device, even without the User's knowledge.
Where explicitly stated on www.medschoolcoach.com, the User may download, copy and/or share some content available through www.medschoolcoach.com for its sole personal and non-commercial use and provided that the copyright attributions and all the other attributions requested by the Owner are correctly implemented.
Any applicable statutory limitation or exception to copyright shall stay unaffected.
Access to external resources
Through www.medschoolcoach.com Users may have access to external resources provided by third parties. Users acknowledge and accept that the Owner has no control over such resources and is therefore not responsible for their content and availability.
Conditions applicable to any resources provided by third parties, including those applicable to any possible grant of rights in content, result from each such third parties’ terms and conditions or, in the absence of those, applicable statutory law.
Acceptable use
Www.medschoolcoach.com and the Service may only be used within the scope of what they are provided for, under these Terms and applicable law.
Users are solely responsible for making sure that their use of www.medschoolcoach.com and/or the Service violates no applicable law, regulations or third-party rights.
Therefore, the Owner reserves the right to take any appropriate measure to protect its legitimate interests including by denying Users access to www.medschoolcoach.com or the Service, terminating contracts, reporting any misconduct performed through www.medschoolcoach.com or the Service to the competent authorities – such as judicial or administrative authorities - whenever Users engage or are suspected to engage in any of the following activities:
- violate laws, regulations and/or these Terms;
- infringe any third-party rights;
- considerably impair the Owner’s legitimate interests;
- offend the Owner or any third party.
TERMS AND CONDITIONS OF SALE
Paid Products
Some of the Products provided on www.medschoolcoach.com, as part of the Service, are provided on the basis of payment.
The fees, duration and conditions applicable to the purchase of such Products are described below and in the dedicated sections of www.medschoolcoach.com.
Product description
Prices, descriptions or availability of Products are outlined in the respective sections of www.medschoolcoach.com and are subject to change without notice.
While Products on www.medschoolcoach.com are presented with the greatest accuracy technically possible, representation on www.medschoolcoach.com through any means (including, as the case may be, graphic material, images, colors, sounds) is for reference only and implies no warranty as to the characteristics of the purchased Product.
The characteristics of the chosen Product will be outlined during the purchasing process.
Purchasing process
Any steps taken from choosing a Product to order submission form part of the purchasing process.
The purchasing process includes these steps:
- Users must choose the desired Product and verify their purchase selection.
- After having reviewed the information displayed in the purchase selection, Users may place the order by submitting it.
Order submission
When the User submits an order, the following applies:
- The submission of an order determines contract conclusion and therefore creates for the User the obligation to pay the price, taxes and possible further fees and expenses, as specified on the order page.
- In case the purchased Product requires an action from the User, such as the provision of personal information or data, specifications or special wishes, the order submission creates an obligation for the User to cooperate accordingly.
- Upon submission of the order, Users will receive a receipt confirming that the order has been received.
All notifications related to the described purchasing process shall be sent to the email address provided by the User for such purposes.
Prices
Users are informed during the purchasing process and before order submission, about any fees, taxes and costs (including, if any, delivery costs) that they will be charged.
Prices on www.medschoolcoach.com are displayed:
- either exclusive or inclusive of any applicable fees, taxes and costs, depending on the section the User is browsing.
Methods of payment
Information related to accepted payment methods are made available during the purchasing process.
Some payment methods may only be available subject to additional conditions or fees. In such cases related information can be found in the dedicated section of www.medschoolcoach.com.
All payments are independently processed through third-party services. Therefore, www.medschoolcoach.com does not collect any payment information – such as credit card details – but only receives a notification once the payment has been successfully completed.
If a payment through the available methods fails or is refused by the payment service provider, the Owner shall be under no obligation to fulfill the purchase order. If a payment fails or is refused, the Owner reserves the right to claim any related expenses or damages from the User.
Purchase via app store
Www.medschoolcoach.com or specific Products available for sale on www.medschoolcoach.com must be purchased via a third-party app store. To access such purchases, Users must follow the instructions provided on the relevant online store (such as "Apple App Store" or "Google Play"), which may vary depending on the particular device in use.
Unless otherwise specified, purchases done via third-party online stores are also subject to such third-parties’ terms and conditions, which, in case of any inconsistency or conflict, shall always prevail upon these Terms.
Users purchasing through such third-party online stores must therefore read such terms and conditions of sale carefully and accept them.
Retention of Product ownership
Until payment of the total purchase price is received by the Owner, any Products ordered shall not become the User’s property.
Retention of usage rights
Users do not acquire any rights to use the purchased Product until the total purchase price is received by the Owner.
Delivery
Delivery of digital content
Unless otherwise stated, digital content purchased on www.medschoolcoach.com is delivered via download on the device(s) chosen by Users.
Users acknowledge and accept that in order to download and/or use the Product, the intended device(s) and its respective software (including operating systems) must be legal, commonly used, up-to-date, and consistent with current market-standards.
Users acknowledge and accept that the ability to download the purchased Product may be limited in time and space.
Performance of services
The purchased service shall be performed or made available within the timeframe specified on www.medschoolcoach.com or as communicated before the order submission.
Contract duration
Subscriptions
Subscriptions allow Users to receive a Product continuously or regularly over time. Details regarding the type of subscription and termination are outlined below.
Subscriptions handled via Apple ID
Users may subscribe to a Product using the Apple ID associated with their Apple App Store account by using the relevant process on www.medschoolcoach.com. When doing so, Users acknowledge and accept that
- any payment due shall be charged to their Apple ID account;
- subscriptions are automatically renewed for the same duration unless the User cancels at least 24 hours before the current period expires;
- any and all fees or payments due for renewal will be charged within 24-hours before the end of the current period;
- subscriptions can be managed or cancelled in the Users’ Apple App Store account settings.
The above shall prevail upon any conflicting or diverging provision of these Terms.
Termination
Subscriptions may be terminated by sending a clear and unambiguous termination notice to the Owner using the contact details provided in this document, or — if applicable — by using the corresponding controls inside www.medschoolcoach.com.
User rights
Right of withdrawal
Unless exceptions apply, the User may be eligible to withdraw from the contract within the period specified below (generally 14 days), for any reason and without justification. Users can learn more about the withdrawal conditions within this section.
Who the right of withdrawal applies to
Unless any applicable exception is mentioned below, Users who are European Consumers are granted a statutory cancellation right under EU rules, to withdraw from contracts entered into online (distance contracts) within the specified period applicable to their case, for any reason and without justification.
Users that do not fit this qualification, cannot benefit from the rights described in this section.
Exercising the right of withdrawal
To exercise their right of withdrawal, Users must send to the Owner an unequivocal statement of their intention to withdraw from the contract.
To this end, Users may use the model withdrawal form available from within the “definitions” section of this document. Users are, however, free to express their intention to withdraw from the contract by making an unequivocal statement in any other suitable way. In order to meet the deadline within which they can exercise such right, Users must send the withdrawal notice before the withdrawal period expires.
When does the withdrawal period expire?
- Regarding the purchase of goods, the withdrawal period expires 14 days after the day on which the User or a third party – other than the carrier and designated by the User – takes physical possession of the goods.
- Regarding the purchase of several goods ordered together but delivered separately or in case of purchase of a single good consisting of multiple lots or pieces delivered separately, the withdrawal period expires 14 days after the day on which the User or a third party – other than the carrier and designated by the User – acquires physical possession of the last good, lot or piece.
Effects of withdrawal
Users who correctly withdraw from a contract will be reimbursed by the Owner for all payments made to the Owner, including, if any, those covering the costs of delivery.
However, any additional costs resulting from the choice of a particular delivery method other than the least expensive type of standard delivery offered by the Owner, will not be reimbursed.
Such reimbursement shall be made without undue delay and, in any event, no later than 14 days from the day on which the Owner is informed of the User’s decision to withdraw from the contract. Unless otherwise agreed with the User, reimbursements will be made using the same means of payment as used to process the initial transaction. In any event, the User shall not incur any costs or fees as a result of such reimbursement.
…on the purchase of physical goods
Unless the Owner has offered to collect the goods, Users shall send back the goods or hand them over to the Owner, or to a person authorized by the latter to receive the goods, without undue delay and in any event within 14 days from the day on which they communicated their decision to withdraw from the contract.
The deadline is met if the goods are handed to the carrier, or otherwise returned as indicated above, before the expiration of the 14-days-period for returning the goods. The reimbursement may be withheld until reception of the goods, or until Users have supplied evidence of having returned the goods, whichever is the earliest.
Users shall only be liable for any diminished value of the goods resulting from the handling of the goods outside of that which is necessary to establish their nature, characteristics and functioning.
The costs of returning the goods are borne by the User.

- any errors, mistakes, or inaccuracies of content;
- personal injury or property damage, of any nature whatsoever, resulting from User access to or use of the Service;

- any interruption or cessation of transmission to or from the Service;
- any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service;

This limitation of liability section shall apply to the fullest extent permitted by law in the applicable jurisdiction whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if company has been advised of the possibility of such damage.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore the above limitations or exclusions may not apply to User. The terms give User specific legal rights, and User may also have other rights which vary from jurisdiction to jurisdiction. The disclaimers, exclusions, and limitations of liability under the terms shall not apply to the extent prohibited by applicable law.
Indemnification
The User agrees to defend, indemnify and hold the Owner and its subsidiaries, affiliates, officers, directors, agents, co-branders, partners, suppliers and employees harmless from and against any and all claims or demands, damages, obligations, losses, liabilities, costs or debt, and expenses, including, but not limited to, legal fees and expenses, arising from
- User’s use of and access to the Service, including any data or content transmitted or received by User;
- User’s violation of these terms, including, but not limited to, User’s breach of any of the representations and warranties set forth in these terms;
- User’s violation of any third-party rights, including, but not limited to, any right of privacy or intellectual property rights;
- User’s violation of any statutory law, rule, or regulation;
- any content that is submitted from User’s account, including third party access with User’s unique username, password or other security measure, if applicable, including, but not limited to, misleading, false, or inaccurate information;
- User’s wilful misconduct; or
- statutory provision by User or its affiliates, officers, directors, agents, co-branders, partners, suppliers and employees to the extent allowed by applicable law.
Common provisions
No Waiver
The Owner’s failure to assert any right or provision under these Terms shall not constitute a waiver of any such right or provision. No waiver shall be considered a further or continuing waiver of such term or any other term.
Service interruption
To ensure the best possible service level, the Owner reserves the right to interrupt the Service for maintenance, system updates or any other changes, informing the Users appropriately.
Within the limits of law, the Owner may also decide to suspend or discontinue the Service altogether. If the Service is discontinued, the Owner will cooperate with Users to enable them to withdraw Personal Data or information and will respect Users' rights relating to continued product use and/or compensation, as provided for by applicable law.

Venue of jurisdiction
The exclusive competence to decide on any controversy resulting from or connected to these Terms lies with the courts of the place where the Owner is based, as displayed in the relevant section of this document.
Exception for Consumers in Europe
The above does not apply to any Users that qualify as European Consumers, nor to Consumers based in the United Kingdom, Switzerland, Norway or Iceland.
